When should I apply?
You submit an application for a document confirming the right of residence of an EU citizen after 5 years of uninterrupted stay on the territory of the Republic of Poland together with an EU citizen.
You submit the application in person. The requirement to submit an application in person does not apply a minor.
application on behalf of a minor are submitted by parents or court-appointed guardians or one of the parents or one of the court-appointed guardians.
If you apply without formal deficiencies or you complete the formal deficiencies within the time limit indicated by us, the proceedings will be initiated.
Where to submit the application?
Correctly and completely filled out proposal in Polish, submit to the Department for Foreigners, ul. Marszałkowska 3/5 Warszawa, stand 21 (take a ticket with the letter "I").
If you are unable to submit the application in person, please send a complete and correctly completed application in paper form by post. You can also submit an application via our office at ul. Marszałkowska 3/5 Warsaw. Documents submitted to the Registration Office are not verified and are not confirmed to be true copies of the originals. The service is available after prior reservation of the date and time e-service portal. By booking an appointment, you accept at the same time registration regulations.
If you submit your application by post or through the application office, you will have to wait for the Office's summons. Then, after receiving the summons, you will be obliged, within the time limit specified in the summons, to present the original documents. During the visit, you can also submit other required documents.
What documents do I need to attach to the application?
Documents necessary to initiate the procedure (so-called formal requirements):
- proposal in one copy, completed in Polish in accordance with the instruction, the application for a minor must be signed by parents or legal guardians appointed by the court or one of the parents or legal guardian appointed by the court;
- 4 Photos;
- photocopy a valid travel document or other document confirming identity and citizenship (original available for inspection);
Documents needed to issue a residence card of a family member of an EU citizen:
- a copy of the certificate of registration of the residence of the European Union citizen you are joining;
- documents confirming running a common household;
- documents confirming the fulfillment of the conditions for the right of residence by an EU citizen;
- confirmation documents uninterrupted stay on the territory of the Republic of Poland;
- documents confirming family ties together with a document confirming citizenship and identity of an EU citizen:
- spouse – a document confirming the conclusion of a marriage (a document confirming family ties with a sworn translation into Polish),
- descendant (a child or a child of a spouse, up to 21 years of age or dependent on an EU citizen or his/her spouse) – a document confirming the existence of family ties and a document confirming age or being dependent on an EU citizen or his/her spouse (e.g. birth certificate, marriage certificate together with a sworn translation into Polish).
- preliminary (parent or parent of his spouse, who is dependent on an EU citizen or his spouse) - a document confirming the existence of family ties and a document confirming being dependent on a European Union citizen or his spouse.
- parents a minor of an EU citizen - a document confirming that the minor of the European Union citizen is actually cared for and a document confirming that the minor of the European Union citizen is maintained by him/her.
What should I know?
If you need to clarify or clarify the submitted documents, during the proceedings you may be asked for additional, personal explanations at the office.
If the application is submitted after the deadline (during illegal stay) - the initiation of the procedure for extending the visa is refused.
During the period for lodging an appeal, the party may waive the right to appeal against the public administration authority that issued the decision. On the day of delivery to the public administration body of the statement on the waiver of the right to appeal by the last party to the proceedings, the decision becomes final and binding. If the right to appeal against the decision is waived, there is no right to appeal to the administrative court.
