Permanent residence card of a family member of a Polish citizen who is not an EU citizen

When to apply?

Proposal You apply for a permanent residence card for a family member of a Polish citizen after 5 years of uninterrupted residence in the territory of the Republic of Poland or after 3 years of uninterrupted residence in the territory of the Republic of Poland if you are the spouse of a Polish citizen.

You submit the application in person. The requirement to submit an application in person does not apply a minor.

If you apply without formal deficiencies or formal deficiencies will be supplemented within the time limit indicated by us, the procedure will be initiated.

Where to submit the application?

Correctly and completely filled out proposal in Polish, submit in person at the Department for Foreigners in Warsaw at ul. Marszałkowska 3/5, mezzanine, stand 21 (take a ticket with the letter "I").

If you are unable to submit your application in person, please send a complete and correctly completed paper application by post. You can also submit it through the registry office, ul. Marszałkowska 3/5 Warsaw, pl. Bankowy 3/5 Warsaw.

If you submit your application by post or through the application office, you will have to wait for the Office's summons. Then, after receiving the summons, you will be required to appear in person on the date indicated in the summons in order to present the original documents. During the visit, you can also submit other required documents.

What documents to submit?

Documents necessary to initiate the procedure (so-called formal requirements):

  • proposal in one copy, completed in Polish, in accordance with the instruction and signed, in the case of a minor, an application signed by parents or legal guardians appointed by the court or one of the parents or a legal guardian appointed by the court;
  • 4 Photos;
  • photocopy a valid travel document or other document confirming identity and citizenship (original available for inspection),
  • fingerprinting  (in the case of minors, fingerprints are taken from children who have reached the age of 6 on the day of submitting the application).

Documents needed to grant permission to issue a permanent residence card:

  • documents confirming 5 years uninterrupted period of stay on the territory of the Republic of Poland together with a Polish citizen, or 3 years of uninterrupted stay in the case of a spouse of a Polish citizen;
  • documents stating the reasons for breaks in stay, if any, together with documents confirming the fulfillment of the conditions of stay during this period;
  • a document confirming family ties, i.e. documents confirming the conclusion of a marriage recognized by Polish law together with a document confirming the citizenship and identity of a Polish citizen;

and/ or

  • a document confirming the existence of family ties and documents confirming age and attesting to the provision of actual care by a Polish citizen, together with a document confirming the citizenship and identity of the Polish citizen;
All documents are submitted in original/certified copy. You can complete the missing documents in person at our Department, ul. Marszałkowska 3/5 Warsaw, stand 21, ticket with the letter "I" or through the registry office of the office, ul. Marszałkowska 3/5 Warsaw, pl. Bankowy 3/5 Warsaw.

How can I get a permanent residence card?

You collect the permanent residence card in person at the seat of our Faculty, ul. Marszałkowska 3/5 Warszawa, stand 21, take a ticket with the letter "V".

Where a permanent residence card has been issued babywho has not turned 13 years of age by the date of its receipt, the receipt of the document is made by a parent, legal guardian or custodian, respectively, after presenting a valid document confirming his identity.

When collecting the permanent residence card, the presence of a child who is 6 years old by the date of submitting the application for the document is required.

Customer reception hours: Monday 10:00-17:30, Tuesday - Friday 8:00-15:00.

In case of loss of the permanent residence card, a new document is issued.

What should I know?

The party may appeal against the negative decision to the Head of the Office for Foreigners - through the Mazowieckie Voivode - within 14 days from the date of its delivery.

During the period for lodging an appeal, the party may waive the right to appeal against the public administration authority that issued the decision.
On the day of delivery to the public administration body of the statement on the waiver of the right to appeal by the last party to the proceedings, the decision becomes final and binding.
If the right to appeal against the decision is waived, there is no right to appeal to the administrative court.

What are my obligations after issuing the document?

You should report to the voivode competent for the place of your residence in the case of:

  • changes to the information on the card
  • its damage
  • lost document
  • changing the image of your face to the extent that it makes it difficult or impossible to identify you properly

In the above-mentioned cases, you can apply for a replacement of the existing card.

If the permanent residence card expires, a new document is issued.
