When should I apply for a permit change?
You should submit an application for a change of a temporary residence permit in a situation where:
- you intend to start work for an entity other than specified in the permit, or
- you intend to change your position, or
- you will receive lower remuneration than specified in the permit.
Submit the application for a change of the permit immediately - performing work on conditions other than those specified in the permit is against the regulations.
There is no established template for a form for changing a temporary residence permit in order to perform work in a profession requiring high qualifications. The application is submitted in the form of an application written by the party to the proceedings or its representative.
During the first 2 years of your stay in Poland on the basis of the EU blue card, you cannot start working for an entity other than the one specified in the permit, you cannot change the position you are employed in and you cannot receive remuneration lower than that specified in the permit - without changing this permits.

The date of submission of the application shall be the date of submission of the application to the Office or the date of the postmark. When submitting an application in this way, the submitted documents are not certified as true copies of the original. Proceedings are initiated only after completing the formal deficiencies of the application, in accordance with the request sent by the Office. The waiting time for the first call depends on the number of applications awaiting registration and can range from several to several weeks.
When will we refuse to change the permit?
We will refuse to change your permit if the period during which you remain unemployed:
- exceeds 3 months from the day of losing your job to the day you submit an application for a change in the permit due to the change of the entity entrusting him with the performance of work;
- occurred more than 2 times during the validity of the permit.
You will also receive a negative decision if:
- you did not notify the voivode of losing your job within 15 days of losing it,
- you no longer meet the conditions for granting the permit,
- the entity that will entrust you with work has the ability to meet staffing needs on the local labor market,
- your gross annual remuneration, resulting from the monthly or annual remuneration, indicated in the contract is lower than the equivalent of 150% of the amount of the average remuneration in the national economy in the year preceding the conclusion of the contract announced by the President of the Central Statistical Office.
- the period of validity of the amended permit exceeds 3 years.
When do I not need to change my permit?
A permit change is not required in the case of:
- change of the seat or place of residence, name or legal form of the entity entrusting work to a foreigner,
- takeover of the employer or its part by another employer, or transfer of the workplace or its part to another employer,
- replacing a civil law contract with an employment contract.
What documents to submit?
Documents needed to change your permit:
- an application for a change of decision signed by you, submitted to the voivode competent for the place of your current stay
- information from the staroste, competent for the main place of your work, about the inability to meet the employer's staffing needs based on the registers of the unemployed and job seekers or about the negative result of recruitment organized for the employer, issued not earlier than 180 days before submitting the application, if it is required;
Check if you need information from the starost.
- if the starost's information contains requirements for candidates to take up work on the offered position, attach documents confirming that you meet these requirements;
- if you are exempt from the obligation to submit information to the starosta, attach documents confirming this;
- Annex No. 1 to the application completely completed by the employer, signed by a person authorized to represent the company;
- current documents confirming that you have health insurance;
- if you work in a regulated profession – also complete documents confirming formal qualifications or meeting the required conditions. Check if your profession is on list of regulated professions in Poland;
- employment contract, outwork contract, civil law contract on the basis of which you perform work, provide services or remain in a business relationship concluded for a period of at least 1 year;
In order to speed up the procedure, it is worth attaching a current printout from the company's KRS/CEiDG to Annex 1 to the application and a copy of the original decision on granting a temporary residence permit for the purpose of work in a profession requiring high qualifications (i.e. the one to be changed).
You submit all documents in original/certified copy. Use the cover letter when sending documents to the Department of Foreigners' Affairs.
Attention! Attaching all the above-mentioned documents to the application when submitting it may reduce the amount of official correspondence and shorten the time of settling the case. In the event of the need to clarify or clarify the evidence held by the authority in the case during the proceedings, you may be called upon to provide other documents or to testify confirming the circumstances referred to in the application. Documents should be submitted in originals or in photocopies together with the originals for inspection. If documents drawn up in a foreign language are attached to the application, it is also required to submit a translation of this document into Polish, made by a sworn translator.
What should I know?
Missing documents in the case should be supplemented in accordance with the content of the summons received.
It is your duty to inform the Voivode who issued your permit about the termination of work within 15 days of losing employment. If you want to work for another employer, you must submit a new application for temporary residence or an application for a change. If you do not submit a new application or application for a change, we will start the procedure of withdrawing your permit, because the purpose of your stay, which you declared when submitting the application for temporary residence, has ceased. If you fail to do so, we may refuse to grant another temporary residence permit.
Have you received a decision inconsistent with your request?
The decision may be appealed against to the Head of the Office for Foreigners. You submit the appeal through the Mazowieckie Voivode within 14 days from the date of delivery of the decision. If the Mazowieckie Voivode decides that your appeal deserves to be considered in its entirety, he may issue a new decision within 7 days from the date of receipt of the appeal, in which he will repeal or amend the contested decision. If, after receiving the appeal, the Voivode does not issue a new decision, then your case files along with the appeal will be transferred to the Head of the Office for Foreigners within 7 days from the date of receipt of the appeal by the authority.
