When to apply?
permits for temporary stay in order to use long-term mobility you can get if you have residence permit issued by another Member State of the European Union with the annotation "ICT" and you will perform work as a managerial staff member, specialist or employee undergoing an internship in the so-called receiving entity having its seat in Poland for a period longer than 90 days.
Proposal can be submitted even before your arrival in Poland. If you are staying in Poland, the application for a temporary residence permit in order to use long-term mobility must be submitted by the host entity no later than on the last day of your legal stay on the territory of Poland.
If the application was submitted on time and will not be in it formal deficiencies or formal deficiencies will be supplemented within the time limit indicated by us, your stay will be legal from the date of submitting the application to the date on which decision on this matter will become final.

The date of submission of the application shall be the date of submission of the application to the Office or the date of the postmark. When submitting an application in this way, the submitted documents are not certified as true copies of the original. The procedure is initiated only after the formal deficiencies of the application have been supplemented, in accordance with the request sent by the Office. The waiting time for the first call depends on the number of applications awaiting registration and can range from several to several weeks.
What documents?
Documents needed to initiate the procedure (so-called formal requirements):
- proposal in 1 copy, completed in accordance with the instruction and signed by a person acting on behalf of and for the host entity. The application should be signed by a person authorized to represent the host entity or a proxy designated by that person. Then attach the relevant power of attorney to the application. In the case of companies, Appendix 1 should be signed by a person designated to represent the company, indicated in the National Court Register (KRS). You can complete the application form electronically, then print and sign it;
- 4 Photos;
- photocopy a valid travel document;
- to start the procedure, you will also need confirmation that you have applied stamp duty in the amount of PLN 440, and in the case when a foreigner is staying in Poland, personal appearance and submission by him fingerprints
If the formal deficiencies are not corrected, the application will be left unprocessed and the proceedings will not be conducted.
However, if the foreigner is staying in Poland, in the event of the removal of formal deficiencies after the deadline has passed and before the authority issues a notification that the application has been left without consideration, the date of submission of the application should be considered to be the day on which all formal deficiencies in the application have been removed. Removing formal deficiencies after the required deadline makes it impossible to place a stamp in the foreigner's passport confirming that the host entity has submitted an application for a temporary residence permit.
Documents needed to grant the permit (submitted by the receiving entity):
- photocopy of the residence card with the annotation "ICT" issued by another EU country;
- documents confirming formal qualifications or fulfillment of conditions that are required in the case of performing work in regulated profession. Check if your profession is on the list of regulated professions in Poland;
- documents confirming the possibility of returning to parent employer or another company belonging to the same group of companies, established outside the EU, after the end of the intra-corporate transfer period;
- a document confirming the amount of remuneration, which must be: higher than the income entitling to cash benefits from social assistance specified in the Act of 12 March 2004 on social assistance in relation to a foreigner and each dependent family member and not lower than employees' remuneration performing work of a comparable type or on a comparable position and in the same working time on the territory of the Republic of Poland; remuneration not lower than 70% of the average gross monthly remuneration in the national economy in the voivodeship where the host entity has its registered office, in the year preceding the submission of the application for a permit, announced by the President of the Central Statistical Office;
- a document confirming possession health insurance;
- a document confirming possession provided place of residence;
- an agreement on the basis of which the foreigner is to perform work, concluded in writing, or a document issued by the parent employer, constituting the basis for the intra-corporate transfer, specifying: the period of intra-corporate transfer, the seat of the host entity, the foreigner's position in the host entity, remuneration and other working conditions receiving entity.
You submit all documents in original/certified copy. Use the cover letter when sending documents to the Department of Foreigners' Affairs.
Attention! Attaching all the above-mentioned documents to the application when submitting it may reduce the amount of official correspondence and shorten the time of settling the case. In the event of the need to clarify or clarify the evidence held by the authority in the case during the proceedings, you may be called upon to provide other documents or to testify confirming the circumstances referred to in the application. Documents should be submitted in originals or in photocopies together with the originals for inspection. If documents drawn up in a foreign language are attached to the application, it is also required to submit a translation of this document into Polish, made by a sworn translator.
The amount of remuneration specified in your contract may not be lower than 70% of the average monthly gross remuneration in the national economy in the voivodship where the host entity has its registered office, in the year preceding the submission of the application.
What should I know?
The procedure will not start (the procedure will not be initiated), If:
- on the day of submitting the application, you are applying for or already have a permit:
- in order to pursue full-time higher education or doctoral studies in Poland
- to conduct scientific research
- on the day of submitting the application, you are an employee of an enterprise based in another EU Member State and you are temporarily delegated by the employer to provide services on the territory of Poland
- you run a business
- you are employed by a temporary employment agency or another enterprise providing employees to work under the supervision and management of another enterprise or are transferred within the enterprise with the participation of an entity conducting business activity in the field of providing employment services.
The permit entitles you to work in Poland under the conditions specified therein.
If you have been granted a temporary residence permit, the host entity is obliged to notify the voivode who granted the permit within 15 working days of the cessation of the reason for granting the permit. If the temporary residence permit was granted by the Head of the Office for Foreigners in the second instance, the above-mentioned the notification is addressed to the voivode who ruled on granting the permit in the first instance.
Have you received a decision inconsistent with your request?
The decision may be appealed against to the Head of the Office for Foreigners. You submit the appeal through the Mazowieckie Voivode within 14 days from the date of delivery of the decision. If the Mazowieckie Voivode decides that your appeal deserves Entire to be taken into account, may issue a new decision within 7 days from the date of receipt of the appeal in which it repeals or changes the contested decision. If, after receiving the appeal, the Voivode does not issue a new decision, then the files of your case together with the appeal will be transferred to the Head of the Office for Foreigners within 7 days from the date of receipt of the appeal by the authority.

I have received a decision - how to obtain a residence card?
In the case of obtaining a work permit as part of an intra-corporate transfer and the Foreigner's entry into Poland, the same rules for obtaining a residence card apply as in the case of family reunification when the spouse stays outside Poland - an application for the first residence card should be submitted.
