When to apply?
Submit an application if you intend to stay in Poland for more than 3 months i purpose of your stay is running a business.
Running a business also means holding shares in a company and performing work at the same time by:
- performing functions in the management board a limited liability company or a joint-stock company that you have established or whose shares or stocks you have subscribed or purchased;
- managing the affairs of a limited partnership or limited joint-stock partnership by a general partner;
- acting as proxy.
A printed and correctly completed application for a permit temporary stay you submit in person, no later than on the last day of your legal stay on the territory of Poland.
If you submit the application within the indicated period and it will not be in it formal deficiencies or you complete formal deficiencies within the time limit indicated by us, your stay will be legal from the date of submitting the application to the date on which decision will become final in your case.

If you run a business in Poland and submit an application for a temporary residence and work permit, we will be forced to do so refuse to initiate proceedings. If you hold a function in the management board of a legal person subject to entry in the register of entrepreneurs, whose shares or stocks you do not hold, you should submit an application for temporary residence and work permit. Remember, however, that then we will also check the condition of the company you work for.
The procedure for granting a temporary residence permit for the purpose of conducting business activity requires analyzing many financial documents of the company, as well as examining the impact of the business activity on the Polish economy, which is why the procedures are more complicated and take longer. Remember that completing as many documents as possible regarding your business activity when submitting the application greatly streamlines the procedure.
Where to submit the application?

Applications for temporary stay are accepted in 3 locations in Warsaw:

Remember that in addition to the application generated in the inPOL system, it is still necessary to complete the application in the system MOS and deliver the completed forms by the agreed date for submitting the application in person at the Office.
We will send the necessary information regarding the matter on an ongoing basis to the telephone number provided in the inPOL system, including an SMS with information on receipt of the residence card.
New appointment times will become available between 8am-10am each day, so if there are no more appointment times available, please try again the next day.
The number of people registered for a given day depends on the staffing and space capabilities of the office.
People who come for an appointment without completed applications in the inPOL and MOS systems will not be served.
The above solution is aimed at more efficient processing of cases related to the constantly increasing number of foreigners in Masovia.
It is worth submitting a completely completed application in person, as it will significantly streamline the procedure for legalizing your stay. If you are unable to submit the application in person by the last day of your legal stay, please send a complete and correctly completed application in paper version to meet the deadline. post office.
What counts is the date of posting the correspondence at the post office. If you submit the application by post, you will have to wait for the Office's call, and the process of legalizing your stay will be much longer. Then, after receiving the summons, you will be obliged to appear in person on the indicated date, in order to, among other things, assemblies fingerprints. Applications are considered in the order in which they were received.

What documents to submit?
Documents needed to initiate the procedure (so-called formal requirements):
- proposal in 2 copies, completed in accordance with the instructions;
- 4 Photos;
- photocopy a valid travel document (original available for inspection). In particularly justified cases, when you do not have a valid travel document and you are unable to obtain it, you can present another one a document confirming your identity;
- Annex No. 1 to the application, completely completed by the employer, signed by a person authorized to represent the company, if the purpose of your stay is to perform work by performing functions in the management board of a limited liability company or a joint-stock company that you have established or whose shares or stocks you took or purchased, or running the affairs of a limited partnership or limited joint-stock partnership by a general partner, or acting as a proxy. - to start the procedure, you will also need confirmation that you have applied stamp duty in the amount of PLN 340, yours personal appearance and submission fingerprints.
Completion of the above-mentioned activities on time, while maintaining the condition of submitting the application during legal stay, will allow you to include in your passport stamp confirming the submission of the application.
If you do not complete the formal defects, your application will be left unprocessed and the proceedings will not be conducted.
However, in the event of removal of formal defects after the expiry of the deadline, and before the authority sends a notification that the application has not been considered, the date of submission of the application should be considered the date of supplementing all formal defects of the application. In the above situation, it is not possible to place a stamp in the passport confirming the submission of an application for a temporary residence permit.

I run a sole proprietorship
You must submit basic supporting documents:

possession stable and regular source of income;

First, we will check whether in the year preceding the submission of the application, the company achieved the income required by the Act on foreigners. The required income is 12 times average monthly gross salary in the national economy published by the President of the Central Statistical Office. The amount of income is calculated according to rates in the year preceding the submission of the application, in the province where the entrepreneur has his place of residence.
If your business operated in the previous tax year, you must submit:
- PIT - 36 or PIT-28 for the tax year preceding the submission of the application together with confirmation of posting to the tax office or a certificate from the tax office about the income achieved;
- a certificate from the Social Insurance Institution (ZUS) on the lack of arrears in the payment of contributions and from the tax office on the absence of tax arrears of your company.
In addition, submit:
- documents proving that your business was employing at least 2 Polish citizens or foreignerswho have been granted subsidiary protection in Poland, who have refugee status granted in Poland, a permanent residence permit, a long-term resident's European Union residence permit, a residence permit for humanitarian reasons, a tolerated stay permit in Poland, enjoying temporary protection in Poland, being citizens of European Union Member States, a citizen of a European Economic Area country not belonging to the European Union, a citizen of a country that is not a party to the Agreement on the European Economic Area, who may exercise the freedom of movement of persons on the basis of an agreement concluded by that country with the European Community and its Member States for an indefinite period and full-time, min. for 1 year before submitting the application.
Documents indicating the possibility of meeting these conditions in the future:
- current income and expenses book,
- business plan;
- a bank account statement confirming the possession of funds for the current activity of the entity;
- concluded agreements/contracts;
- confirmation of investments made, e.g. VAT invoices, bills;
- commercial premises lease agreements;
- employment/contract contracts with employees;
- other financial documents confirming the financial condition of your business.
You submit all documents in original/certified copy. Use the cover letter when sending documents to the Department of Foreigners' Affairs.
Attention! Attaching all the above-mentioned documents to the application when submitting it may reduce the amount of official correspondence and shorten the time of settling the case. In the event of the need to clarify or clarify the evidence held by the authority in the case during the proceedings, you may be called upon to provide other documents or to testify confirming the circumstances referred to in the application. Documents should be submitted in originals or in photocopies together with the originals for inspection. If documents drawn up in a foreign language are attached to the application, it is also required to submit a translation of this document into Polish, made by a sworn translator.
I run a company
If you are a member of the management board or a proxy in a given company and you hold shares in it, you should submit an application for a temporary residence permit related to running a business.
Documents needed to grant the permit:

documents confirming possession stable and regular source of income. One of the documents you can submit is a resolution of the shareholders awarding remuneration for serving as a member of the management board or an employment contract for performing work as a member of the management board. If you earn income from other sources, you can also submit an employment contract with another company. Then remember to include the important ones work permit in this position and this company.

- work permit.
An employment contract for performing work as a member of the management board must be signed by a person authorized to conclude contracts with members of the management board - a document confirming this (e.g. power of attorney) must be submitted. - certificate of no arrears in the payment of ZUS contributions and from the tax office of no arrears in taxes of your company.
In addition, submit:
- documents proving that your business was employing at least 2 Polish citizens or foreigners, who have been granted subsidiary protection in Poland, who have refugee status granted in Poland, a permanent residence permit, a long-term resident's European Union residence permit, a residence permit for humanitarian reasons, a tolerated stay permit in Poland, enjoying temporary protection in Poland, who are citizens of Member States of the European Union, a citizen of a European Economic Area country not belonging to the European Union, a citizen of a country that is not a party to the Agreement on the European Economic Area, who may exercise the freedom of movement of persons on the basis of an agreement concluded by that country with the European Community and its Member States for an indefinite period and full-time, min. for 1 year before submitting the application.

- current profit and loss account,
- current balance sheet of the company,
- business plan,
- a statement from the company's bank account, confirming the possession of funds for current operations,
- concluded agreements/contracts,
- confirmation of investments made, e.g. VAT invoices, bills,
- commercial premises lease agreements,
- employment/order contracts with employees,
- other financial documents confirming the financial condition of the company.

I am on the board of the company, but I do not own any shares
If you are a member of the management board of a given company and do not hold shares in that company, submit an application for granting it uniform permit for temporary residence and work. In addition to meeting the conditions for obtaining a uniform permit for temporary residence and work, you will have to prove that the company in which you perform the function meets the income conditions. Then submit the business documents referred to above.
What should I know?

The permit is granted for a period not longer than 3 years.
If you obtained the permit due to performing work by performing functions in the management board of a limited liability company or a joint-stock company whose shares or stocks you hold, or running the affairs of a limited partnership or limited joint-stock partnership as a general partner, or acting as a proxy, the granted permit also entitles you to perform work in this character. Taking up another job requires obtaining a work permit.
It is your duty to inform the Voivode who issued your permit about the termination of business activity within 15 days. If you want to start another business or buy shares in another company, you must submit a new application for temporary residence. If you do not submit a new application, we will start the procedure revoke your permissionbecause it stopped purpose of staywhich you declared when submitting the application for temporary residence. If you fail to do so, we may refuse to grant another temporary residence permit.
Have you received a decision inconsistent with your request?
The decision may be appealed against to the Head of the Office for Foreigners. You submit the appeal through the Mazowieckie Voivode within 14 days from the date of delivery of the decision. If the Mazowieckie Voivode decides that your appeal deserves Entire to be taken into account, may issue a new decision within 7 days from the date of receipt of the appeal in which it repeals or changes the contested decision. If, after receiving the appeal, the Voivode does not issue a new decision, then the files of your case together with the appeal will be transferred to the Head of the Office for Foreigners within 7 days from the date of receipt of the appeal by the authority.

I have received a decision - how to obtain a residence card?
We issue a residence card after obtaining a positive decision on granting a permit.
Wait for an SMS message with the date of receipt of the decision and the card. Remember to inform the Office of any change of residence and contact number.
