Residence card of a family member of a UK citizen

When to apply?

Make proposal for a residence card, not later than on the day following the lapse of 3 months from the date of entry into the territory of the Republic of Poland.

Requirement personal application is not applicable a minor.

You submit the application in person. When submitting an application a minor, who is over 6 years of age, his presence is required.

A printed and correctly completed application in Polish on behalf of a minor submitted by parents or court-appointed guardians or one of the parents or one of the court-appointed guardians. When submitting the application by a minor who has reached the age of 6, his presence is required.

If you submit your application on time and it will not be in it formal deficiencies or you complete the formal deficiencies within the time limit indicated by us, the proceedings will be initiated.

Od a minor, who by the date of submitting the application has turned 6 years of age, fingerprints will be collected when submitting the application.

Where to submit the application?

You can also submit a fully and correctly completed application in paper form - by post. You can also submit an application through the registry office, ul. Marszałkowska 3/5 Warsaw, pl. Bankowy 3/5 Warsaw.

If you submit your application by post or through the application office, you will have to wait for the Office's summons. Then, after receiving the summons, you will be obliged to appear in person on the date indicated in the summons. Original documents must be presented during the visit. You can also submit other required documents.

What documents to submit?

Documents necessary to initiate the procedure (so-called formal requirements):

  • proposal in three copies, completed in Polish in accordance with the instruction, the application for a minor must be signed by parents or legal guardians appointed by the court or one of the parents or legal guardian appointed by the court;  
  • 4 Photos;
  • photocopy a valid travel document or other document confirming identity and citizenship (original available for inspection);
  • fingerprinting (in the case of minors, fingerprints are taken from children who have reached the age of 6 on the day of submitting the application).

Documents needed to issue a residence card of a family member of an EU citizen:

  • a copy of the certificate of registration of the residence of the citizen of the UK you are joining;
  • documents confirming running a common household;
  • documents confirming the fulfillment of the conditions for the right of residence by a citizen of the UK;
  • documents confirming family ties together with a document confirming citizenship and identity of a citizen of the United Kingdom:
    • spouse – a document confirming the conclusion of a marriage (a document confirming family ties with a sworn translation into Polish),
    • descendant (a child or a child of a spouse, up to 21 years of age or dependent on a ZK citizen or his/her spouse) – a document confirming the existence of family ties and a document confirming the age or being dependent on a ZK citizen or his/her spouse (e.g. birth certificate, marriage certificate together with with a sworn translation into Polish).
    • preliminary (parent or parent of his spouse, who is dependent on a ZK citizen or his spouse) - a document confirming the existence of family ties and a document confirming being dependent on a ZK citizen or his spouse.
    • parents a minor of an EU citizen - a document confirming that the minor of the European Union citizen is actually cared for and a document confirming that the minor of the European Union citizen is maintained by him/her.
All documents are submitted in original/certified copy. You can complete the missing documents in person at our Department, ul. Marszałkowska 3/5 Warsaw, stand 21, ticket with the letter "I" or through the registry office of the office, ul. Marszałkowska 3/5 Warsaw, pl. Bankowy 3/5 Warsaw.

How to pick up the document?

You collect your residence card in person at the seat of our Department, stand 21, ul. Marszałkowska 3/5 Warszawa, you need to take a ticket with the letter "V".

If a residence card has been issued to a child who has not turned 13 by the date of its collection, the document is collected by a parent, legal guardian or custodian, respectively, upon presentation of a valid document confirming his/her identity.

When collecting the residence card, the presence of a child who is 6 years old by the date of submitting the application for the document is required.

Customer reception hours: Monday 10:00-17:30, Tuesday - Friday 8:00-15:00.

In case of loss of the residence card, a new document is issued.

What should I know?

The party may appeal against the negative decision to the Head of the Office for Foreigners - through the Mazowieckie Voivode - within 14 days from the date of its delivery.

Before the deadline for filing an appeal expires, the party may waive the right to appeal against the public administration body that issued the decision.

On the day of delivery to the public administration body of the statement on the waiver of the right to appeal by the last party to the proceedings, the decision becomes final and binding.

If the right to appeal against the decision is waived, there is no right to appeal to the administrative court.

What are my obligations after issuing the document?

You should report to the voivode competent for the place of your residence in the case of:

  • changes to the data contained in the document,
  • document loss,
  • damage or other circumstances that make it difficult to determine the identity of the holder.
