When to apply?

Make proposal if you are a spouse of a Polish citizen, you have a temporary residence permit or a permanent residence permit granted in connection with being married to a Polish citizen and you want to obtain a temporary residence permit for your minor child who lives with you in Poland.

The requirement to submit the application in person does not apply to minors under 6 years of age. When submitting an application for a temporary residence permit to a minor who has turned 6 on the day of submitting the application, their presence is required.

In the case of a foreigner who is a minor, the application for a temporary residence permit is submitted by the parents or guardians appointed by the court, or one of the parents or one of the guardians appointed by the court, no later than on the last day of the child's legal stay on the territory of Poland.

Printed and correctly completed application you submit in person. 

If you submit proposal on time and will not be there formal deficiencies or formal deficiencies are completed within the time limit indicated by us, your child's stay will be legal from the date of submitting the application to the date on which decision on this matter will become final

Where to submit the application?

Correctly and completely completed application submit in person at the Department for Foreigners in Warsaw. 

Applications for temporary stay are accepted in 3 locations in Warsaw:

To book an appointment at the office, complete the form below application and point in it mandatory in accordance with the WSC registration regulations, the identification number of the application completed in the system MOS and in the system inPOL 

To make a reservation, it is necessary to complete the application in the MOS and inPOL systems.

We will send the necessary information regarding the matter on an ongoing basis to the telephone number provided in the inPOL system, including an SMS with information on receipt of the residence card.

If you fill out the form correctly, you will receive automatic information regarding sent notification.

Then, within 5 business days you will receive information with the date and place of the visit to the e-mail address provided in the application. Registration will be determined by the order in which applications are received.

If you receive information that the registration limit has been reached due to lack of places or incorrect data, please register for the next session. Information about the next session will be available on our website.

The number of people registered for a given day depends on staffing and accommodation possibilities of the office.

A registered application does not mean signing up to submit an application in person. Registration is determined by the order of applications and the correctness of the indicated data (including numbers from the MOS and inPOL systems), which will be verified.

People who come for an appointment without completed applications in the inPOL and MOS systems will not be served.

The above solution is aimed at more efficient processing of cases related to the constantly increasing number of foreigners in Masovia.

FORM - Registration for submitting an application for temporary residence

It is worth submitting a completely completed application in person, as it will significantly streamline the procedure for legalizing your stay. Please remember that when submitting an application by a minor who is over 6 years old, his or her presence is required.

The date of posting the correspondence at the post office is important. If you submit the application by post, you will have to wait for the Office's summons, and the process of legalizing your stay will be significantly longer. When you receive the summons, you will be obliged to appear with your child who has turned 6 within a specified period, in order to, among other things, submit fingerprints. Applications are considered in the order in which they were received.

What documents to submit?

Documents needed to initiate the procedure (so-called formal requirements):

  • proposal in 1 copy, completed in accordance with the instructions and signed by one of the parents or a court-appointed guardian; 
  • 4 Photos;
  • photocopy a valid travel document  child (original available for viewing). In particularly justified cases, when the child does not have a valid travel document and you are unable to obtain one, you can present another one a document confirming your identity child;
  • to start the procedure, you will also need confirmation that you have applied stamp duty in the amount of PLN 340, personal appearance a child who has reached the age of 6 and has submitted fingerprints.

Completion of the above-mentioned activities on time, while maintaining the condition of submitting the application during legal stay, will allow you to include in your passport stamp confirming the submission of the application.

If you do not complete the formal defects, your application will be left unprocessed and the proceedings will not be conducted.
However, in the event of removal of formal defects after the expiry of the deadline, and before the authority sends a notification that the application has not been considered, the date of submission of the application should be considered the date of supplementing all formal defects of the application. In the above situation, it is not possible to place a stamp in the passport confirming the submission of an application for a temporary residence permit.

Documents needed to grant the permit:

  • birth certificate of the child located in the Polish registry office or a certificate recognized by the law of the Republic of Poland together with translation made by a sworn translator (if the birth certificate was issued outside Poland);
  • a copy of the parent's marriage certificate (in the case of a Polish civil status certificate, the document must be issued not earlier than 3 months before submitting the application);
  • a copy of the spouse's ID card with the original available for inspection;
  • documents confirming that the parent has a residence permit required by law.

You submit all documents in original/certified copy. Use the cover letter when sending documents to the Department of Foreigners' Affairs.

Attention! Attaching all the above-mentioned documents to the application when submitting it may reduce the amount of official correspondence and shorten the time of settling the case. In the event of the need to clarify or clarify the evidence held by the authority in the case during the proceedings, you may be called upon to provide other documents or to testify confirming the circumstances referred to in the application. Documents should be submitted in originals or in photocopies together with the originals for inspection. If documents drawn up in a foreign language are attached to the application, it is also required to submit a translation of this document into Polish, made by a sworn translator.

We grant a temporary residence permit for a child for a period corresponding to the period of validity of the parent's temporary residence permit, but not longer than 3 years. If the parent has a permanent residence permit, we grant a temporary residence permit for the child for a period of 3 years.

What should I know, what should I pay attention to?

The residence card is issued after the decision on granting a temporary residence permit is issued.

Have you received a decision inconsistent with your request?

The decision may be appealed against to the Head of the Office for Foreigners. You submit the appeal through the Mazowieckie Voivode within 14 days from the date of delivery of the decision. If the Mazowieckie Voivode decides that your appeal deserves Entire to be taken into account, may issue a new decision within 7 days from the date of receipt of the appeal in which it repeals or changes the contested decision. If, after receiving the appeal, the Voivode does not issue a new decision, then the files of your case together with the appeal will be transferred to the Head of the Office for Foreigners within 7 days from the date of receipt of the appeal by the authority.

I have received a decision - how to obtain a residence card?

We issue a residence card after obtaining a positive decision on granting a permit.

Wait for an SMS message with the date of receipt of the decision and the card. Remember to inform the Office of any change of residence and contact number.

Remember that to collect a card issued to a minor child who has reached the age of 13, you must come with the child. When a residence card has been issued to a minor who has not reached the age of 13 by the date of its collection, the card is collected by their legal representative or curator.
