Entry of the invitation to the register of invitations

Who can apply?

O entering the invitation into the register of invitations you can claim if:

  • you are a Polish citizen living in Poland or a citizen of a Member State of the European Union, a Member State of the European Free Trade Association (EFTA) - a party to the Agreement on the European Economic Area or the Swiss Confederation, a citizen of the United Kingdom of Great Britain and Northern Ireland referred to in art. 10 sec. 1 lit. bid of the Withdrawal Agreement or a member of his family residing in Poland and having the right of residence or the right of permanent residence in this territory of the Republic of Poland
  • you are a foreigner residing immediately before issuing the invitation legally i continuously for a period of at least 5 years in Poland or having permanent residence permit or zlong-term resident's EU residence permit,
  • you represent a legal person or an organizational unit without legal personality, based in the territory of the Republic of Poland.
An application for the invitation to be entered in the register of invitations may be submitted by the inviter residing in the territory of the Republic of Poland. If the inviter is a foreigner with a temporary residence card or a visa, he should prove that he has been staying in Poland legally and continuously for at least 5 years as at the date of issuing the invitation. In such a case, a decision on granting a temporary residence permit and a photocopy of the passport along with the possessed visas should be presented. When the inviter is a legal person, the application is submitted by a person authorized to incur civil law obligations indicated in the National Court Register.  
An invitation for a foreigner entered in the register of invitations is not a document entitling to work in the territory of the Republic of Poland. The procedure for entering the invitation in the register of invitations is not appropriate if the purpose of stay in the territory of the Republic of Poland is to perform work.

Where to submit the application?

1. At the seat of the Office:

Correctly and completely filled out proposal (in Polish) submit to the Department for Foreigners in Warsaw, at ul. Marszałkowska 3/5, stand no. 9.

To apply, make an appointment via e-service platforms. Logging in to the e-service platform takes place via a trusted profile. You can submit a maximum of 2 applications during one visit. Customers who have an appointment to submit an application do not collect a number from the ticket machine.

Free dates are available every day (Mondays at 10:00, Tuesday-Friday at 08:00) fourteen days in advance. So if there are no more seats available today, try tomorrow. It is worth submitting a fully completed application in person, because it will significantly improve the procedure of entering the invitation into the register of invitations in one day.

2. At the Customer Service Point of the Mazowieckie Voivodeship Office in Warsaw:

    Reception hours: Monday - Friday: 08.00 - 16.00

  • WSC customers are served only on the basis of a number obtained from a ticket machine or an online visit reservation.
  • there is a daily limit - 100 numbers issued by the ticket machine for number C - correspondence submitted in person to the Department of Foreigners' Affairs. You can submit up to 8 cases per number.
  • Online reservations for visits are available on the website www.e-uslugi.mazowieckie.pl. From September this year Online visits for number C can be scheduled every 15 minutes. Up to 8 cases can be submitted during one visit.

If you submit the application by post or at a Customer Service Point, you will have to appear in person to present the original documents. During the visit, you can also submit other required documents.

Documents submitted to the regional offices are not subject to verification and are not certified as true copies. Presentation of the original documents and collection of the invitation takes place at the Department for Foreigners in Warsaw, ul. Marszałkowska 3/5 (stand 9, take a ticket with the letter "G")

What documents to submit?

A natural person

1. Proposal in one copy, completed in accordance with the instruction;

2. Documents confirming the possibility covering the costs related to the foreigner's stay, including the costs of accommodation and meals, covering the costs of the return trip to the country of origin or residence or the costs of transit to a third country that will grant entry permit, e.g.:

  • current printout from a bank account with information about the final balance on this account (i.e. generated not earlier than 30 days before the date of submitting the application),
  • a certificate confirming employment with information on the monthly salary and the type of contract concluded,
  • decision on indexation of old-age or disability pension,

If you are paying the above costs jointly with your spouse, please provide written consent of the spouse to cover the costs together with documents confirming the spouse's financial means.

3. Document confirming legal title to the dwellingif the inviter's flat or a document confirming the possibility of providing the foreigner with accommodation in another place was indicated as the place of accommodation of the invited foreigner, e.g.:

  • deed of ownership of the premises or a current excerpt from the land and mortgage register (if only the deed of ownership of the plot is attached to the case file, a confirmation of commissioning the building for use or a decision on the assessment of real estate tax should be additionally attached),
  • allocation of cooperative premises,
  • municipal premises rental agreement,
  • in the case of delivery of a lease agreement for premises other than municipal, the legal title of the lessor to this premises and to him must be attached consent to the residence of the Foreigner in the above premises,
  • the possibility of providing the foreigner with residence in another place (e.g. hotel reservation confirmed with the stamp and signature of an authorized hotel employee along with information about who is booking the hotel, for whom and for what period). Reservations made via online portals, e.g. Booking.com, are not honored.

4. Presentation of a document confirming identity (e.g. ID card, passport, residence card)

5. Confirmation of payment stamp duty.

You submit all documents in the original or a certified copy.

After the initiation of the procedure for entering the invitation into the register of invitations, it is not allowed to submit new requests later.

A natural person running a business

1. Proposal in 1 copy, completed in accordance with the instruction;

2. Documents confirming the possibility covering the costs related to the foreigner's stay, including the costs of accommodation and meals, covering the costs of the return journey to the country of origin or residence or the costs of transit to a third country that will grant permission for entry, e.g.:

  • the last settlement with the tax office regarding income (in the case of monthly settlements) or a copy of the current PIT along with the confirmation of posting,
  • current bank account statement with information about the final balance on this account (amount of funds on the account required as in the case of natural persons); 

3. Document confirming legal title to the dwellingif the inviter's flat or a document confirming the possibility of providing the foreigner with accommodation in another place was indicated as the place of accommodation of the invited foreigner (documents required as for a natural person) 

4. Copy of the current excerpt from CEiDG

5. Presentation of a document confirming identity (e.g. ID card, passport, residence card)

6. Confirmation of payment stamp duty.

You submit all documents in the original or a certified copy.

Legal person

1. Proposal in 1 copy, completed in accordance with the instruction,

2. Documents confirming the possibility covering the costs related to the foreigner's stay, including the costs of accommodation and meals, covering the costs of the return trip to the country of origin or residence or the costs of transit to a third country that will grant permission for entry, e.g.:

  • CIT - 8 for the previous year with confirmation of posting to the Tax Office,
  • current bank account statement with information about the final balance on this account (the amount of funds on the account is required as in the case of natural persons),

3. Document confirming legal title to the dwellingif the inviter's flat or a document confirming the possibility of providing the foreigner with accommodation in another place was indicated as the place of accommodation of the invited foreigner (documents required as for a natural person),

4. A copy of the current excerpt from the National Court Register,

5. Confirmation of payment stamp duty.

You submit all documents in the original or a certified copy.

Association

1. Proposal in 1 copy, completed in accordance with the instruction,

2. Documents confirming the possibility covering the costs related to the foreigner's stay, including the costs of accommodation and meals, covering the costs of the return journey to the country of origin or residence or the costs of transit to a third country that will grant permission for entry, e.g.:

  • current bank account statement with information about the final balance on this account (the amount of funds on the account is required as in the case of natural persons),

3. Document confirming legal title to the dwellingif the inviter's flat or a document confirming the possibility of providing the foreigner with accommodation in another place was indicated as the place of accommodation of the invited foreigner (documents required as for a natural person),

4. A copy of the current excerpt from the register of associations,

5. Confirmation of payment stamp duty.

You submit all documents in the original or a certified copy.

How long will I wait for a decision?

The voivode will issue a decision in the case immediately after conducting the explanatory proceedings within 30 days. Customers who have an appointment to submit an application, if a set of required documents is submitted, have the option of obtaining an invitation on the same day.  
The application for the invitation of a foreigner may also be submitted by the customer by post or submitted at a Customer Service Point. It takes approximately 30 days for a decision to be made.

Completing missing documents in the case

Documents in the case should be supplemented in accordance with the content of the summons received, at the designated place and time.

Appeal procedure

The party may appeal against the negative decision to the Head of the Office for Foreigners - through the Mazowieckie Voivode - within 14 days from the date of its delivery.

During the period for lodging an appeal, the party may waive the right to appeal against the public administration authority that issued the decision.

On the day of delivery to the public administration body of the statement on the waiver of the right to appeal by the last party to the proceedings, the decision becomes final and binding.

If the right to appeal against the decision is waived, there is no right to appeal to the administrative court.

What should I know?

An invitation entered into the register of invitations is valid for the period indicated therein, for which the inviter invited the foreigner, not longer than 1 year.

The entry of the invitation in the register of invitations shall be invalidated by the Voivode who made the entry by way of a decision. The voivode shall issue a decision on invalidating the entry of the invitation in the register of invitations ex officio or at the request of the inviter, submitted at least 7 days before the beginning of the validity period of the invitation. The invitation expires on the day on which the decision becomes final.

An authorized representative may collect the invitation special power of attorney to receive it (power of attorney template).

The inviter should have financial resources to cover the costs related to the foreigner's stay on the territory of the Republic of Poland, including the costs of accommodation and meals, intended for himself, each dependent family member and each invited foreigner, at least in the amount of PLN 515 for each month planned stay of the foreigner for each of these persons.

If the period for which the foreigner is invited is shorter than a month, the inviter should have financial resources to cover the costs related to the planned stay of the foreigner on the territory of the Republic of Poland in the amount of PLN 515, reduced in proportion to the number of days of the foreigner's stay.

If the invited foreigner is descendant, preliminary or spouse of the inviting spouse, parent of the inviting spouse, siblings of the inviting or child of the inviting spouse, the inviting should have financial resources to cover the costs related to the stay of the invited foreigner on the territory of the Republic of Poland in the amount of at least PLN 200 for each month of the planned stay of the foreigner.

The inviter should also have financial resources to cover the costs of the invited foreigner's return trip to the country of origin or residence or the costs of transit to a third country that will grant entry permit, in the amount equivalent to the ticket to this country, but not less than:

1) PLN 200 – in the case of a return trip or transit to a country neighboring the Republic of Poland;

2) PLN 500 – in the case of a return journey or transit to a Member State of the European Union not neighboring the Republic of Poland or to a Member State of the European Free Trade Association (EFTA) – a party to the Agreement on the European Economic Area or to the Swiss Confederation;

3) PLN 2500 – in the case of a return trip or transit to a country other than those specified in points 1 and 2.

The obligation to have funds to cover the return travel costs of the invited foreigner to the country of origin or residence is considered fulfilled if the inviter proves that the foreigner has a return ticket to the country of origin or residence.
