When should I apply for a permit change?
You should submit an application for a change in a temporary residence and work permit when:
- there has been a change of employer, employer-user, and the work is still performed for the same Temporary Employment Agency for which the temporary residence and work permit was issued;
- you have obtained the right to work without a work permit (e.g. you have completed full-time higher education in Poland), and you have a uniform residence and work permit in which the employer was indicated;
- you continue to work for an employer for whom the Voivode granted you a permit, but the conditions of employment have changed regarding:
- Workplace,
- working time,
- the lowest salary you will receive in a given position,
- the type of contract under which you will work.
NOTE: It is your duty to inform the voivode who issued your permit about the cessation of the reason for granting the permit within 15 days. If you do not submit a new application indicating the new circumstances of your stay in Poland, we will start the procedure of withdrawing your permit, because the purpose of your stay, which you declared when submitting the application for temporary residence, has ceased. If you fail to do so, we may refuse to grant another temporary residence permit.
The obligation to notify any of the entities entrusting the performance of work, listed in the permit, about the loss of work is considered fulfilled if you submit an application for changing the temporary residence and work permit within 15 working days. If you fail to meet this deadline, we will refuse to change your temporary residence and work permit.
If you have changed the main employer for which you received a permit, in order to be able to continue to stay in Poland and work legally, submit a new application for a temporary residence and work permit with a new employer or an application for a change of residence permit.
When do I not need to change my permit?
You do not have to change your temporary residence and work permit when:
- the registered office or place of residence, name or legal form of the employer has changed;
- the employer or its part was taken over by another employer, the workplace or its part was transferred to another employer;
- your civil law contract has been replaced with an employment contract;
- the title of the position has changed and the scope of your responsibilities has not changed;
- there was an increase in working time with a proportional increase in your remuneration.
Where to submit the application?
