Suspension of the deadlines for settling matters related to the legalization of stay

From January 1, 2023 to March 4, 2024, the deadlines for certain matters related to the legalization of the stay of foreigners conducted by voivodeship offices have been suspended. This solution does not result in suspension of proceedings. They will continue to be processed and new applications will be accepted.

The suspension of the deadlines was introduced in connection with a significant additional burden on voivodship offices in the context of the current mass influx of foreigners from the territory of Ukraine and accompanying phenomena. The purpose of the regulation is to enable the adjustment of procedures and functioning of the administration to the exceptional migration situation. Proceedings in voivodeship offices will continue to be conducted in the most efficient manner possible.

The provisions regarding the suspension of deadlines were introduced by the Act of January 13, 2023 amending the Act on assistance to citizens of Ukraine in connection with an armed conflict in the territory of this country and certain other acts, and the Act of April 14, 2023 amending the names of supervised state service universities by the minister responsible for internal affairs, amending the Act on the Police, the Act on the Border Guard, the Act on the State Fire Service and certain other acts.

The acts introduce a legal basis (Article 100d) for suspending, in the period from January 1, 2023 to March 4, 2024, the deadlines for settling the following administrative matters in proceedings conducted by voivodeship offices:

  • granting and withdrawing a temporary residence permit,
  • changes in temporary residence and work permits and temporary residence permits for the purpose of performing work in a profession requiring high qualifications,
  • granting and withdrawing a permanent residence permit,
  • granting and withdrawing a residence permit for a long-term resident of the European Union.

Pursuant to the above provision, the voivode is not obliged to inform the party about failure to settle the case on time, and he will not forward to the Head of the Office for Foreigners reminders for inaction or excessive length of proceedings in the above-mentioned cases. cases by the authorities of the first instance.

The introduced solution applies to all foreigners, regardless of their citizenship.
