Changes regarding the extension to 30 September 2025 suspension of the deadlines for settling matters related to the legalization of stay were specified in the Act of May 15, 2024 amending the Act on assistance to citizens of Ukraine in connection with an armed conflict on the territory of this country and certain other acts. The regulations will enter into force on July 1, 2024.
Therefore, in the period until 30 September 2025 running of deadlines for settling matters relating to:
1) granting the foreigner:
a) temporary residence permits,
b) permanent residence permit,
c) residence permit for a long-term resident of the European Union,
2) changes:
a) temporary residence and work permits,
b) temporary residence permit for the purpose of performing work in a profession requiring high qualifications,
3) withdrawal from a foreigner:
a) temporary residence permits,
b) permanent residence permit,
c) residence permit for a long-term resident of the European Union
- in proceedings conducted by the voivode, they do not start and those that have already started are suspended for this period.
The introduced solution applies to all foreigners, regardless of their citizenship.
The actions performed during the above-mentioned period in the above matters are effective.
This solution does not result in suspension of proceedings. They will continue to be processed and new applications will be accepted.
The suspension of the deadlines was introduced due to the significant additional burden on voivodeship offices in the context of the current mass inflow of foreigners from the territory of Ukraine and the accompanying phenomena. The purpose of the regulations is to enable the procedures and functioning of the administration to be adapted to the exceptional migration situation. Proceedings in the Department of Foreigners' Affairs of the Masovian Voivodeship Office in Warsaw are conducted as efficiently as possible. Applications submitted to the local Department regarding the legalization of the stay of foreigners are processed in the order in which they are received.
During the period of suspension of deadlines, the voivode is not obliged to inform the parties or their representatives about failure to resolve the matter on time, and does not forward reminders submitted in the above-mentioned form to the Head of the Office for Foreigners. cases due to inaction or lengthy conduct of proceedings by the first instance authorities.
Cessation of activities by the authority conducting the proceedings in the above-mentioned matters or making them late, within a period until September 30, 2025, cannot be the basis for invoking legal remedies regarding inaction, delay or violation of the party's right to have the case heard without undue delay.
