Retaining the right of residence or having the right of residence in specific situations that also apply to UK nationals:
Right of residence after cessation of work or other gainful activity:
A UK citizen who has ceased to be an employee or self-employed person retains the right of residence of an employee or self-employed person in the following cases:
- cessation of work or other gainful activity in one's own name and on one's own account as a result of temporary inability to work due to illness or accident or in connection with pregnancy and childbirth, or,
- unintentional unemployment resulting from the unemployment register kept by the poviat labor office;
- take up vocational education or training.
If the period of performing work or performing other gainful activity in one's own name and on one's own account in the territory of the Republic of Poland, preceding unemployment, was shorter than a year, the right of residence vested in an employee or self-employed person is retained by an EU citizen for a period of 6 months from the date of registration in competent poviat employment office.
Retention of the right of residence by a family member of a UK citizen:
A family member who is a UK citizen retains the right of residence in the event of divorce, annulment of marriage, death or departure from the territory of the Republic of Poland of a UK citizen who meets the conditions of residence for more than 3 months.
The right of residence of a studying child of a UK citizen and his parent:
A child of a UK citizen who stays and learns or studies in this territory has the right to stay until the end of education or studies.
A parent caring for a child of a UK citizen residing and learning or studying in this territory has the right of residence until the child reaches the age of majority; this right also applies after the child reaches the age of majority, if the child still requires the presence and care of that parent in order to be able to continue and complete education.
