Uninterrupted stay (Polish citizenship)

The foreigner's stay in Poland is uninterrupted if none of the breaks was longer than 6 months and all breaks did not exceed 10 months in total in the period under review, unless the break was caused by the foreigner's performance of professional duties or work outside Poland on the basis of an agreement concluded with an employer whose registered office is in the Republic of Poland; or accompanying the foreigner referred to above by his spouse or minor child; or a special personal situation requiring presence outside the territory of Poland and it lasted no longer than 6 months; or the break resulted from a trip outside Poland in order to complete an internship or participate in classes provided for in the course of studies at a Polish university. The period of uninterrupted stay is determined depending on the legal provision which is the basis for acquiring Polish citizenship by way of being recognized as a Polish citizen, e.g.

  • in the case of recognition as a Polish citizen pursuant to art. 30 sec. 1 point 1 of the Act, the period of uninterrupted stay is 3 years, so in this case all stays that took place outside the Republic of Poland in the last 3 years (including the Schengen area countries) are given;
  • in the case of recognition as a Polish citizen pursuant to art. 30 sec. 1 point 2 a) and b) the period of uninterrupted stay is 2 years, therefore the stays that took place outside the Republic of Poland in the last 2 years (including Schengen area countries) are given;
  • in the case of recognition as a Polish citizen pursuant to art. 30 sec. 1 point 7, the period of uninterrupted stay is 1 year, so then all stays that took place outside the Republic of Poland in the last year (including Schengen area countries) are given, etc.
