Dictionary of concepts
State register of entrepreneurs who are natural persons. In the register, you can check the current status of your business, company seat, who is its owner, what is the profile of the entrepreneur's activity, etc. You can check the information contained in the register on website.
If the purpose of your stay for which you have been granted a permit has expired, your permit may be cancelled. If purpose of stay has changed and you still want to stay in Poland, submit a new application indicating the new circumstances.
A family member who is not an EU citizen retains the right to stay in Poland in the case of:
1) death of an EU citizen, if he stayed with him on the territory of the Republic of Poland for a period of not less than one year before the date of death of the EU citizen;
2) divorce or annulment of marriage with an EU citizen, if:
- the marriage lasted for at least 3 years before the initiation of divorce or marriage annulment proceedings, including one year during the stay of the EU citizen on the territory of the Republic of Poland, or
- as a former spouse of an EU citizen, he takes care of his children, based on an agreement between former spouses or on the basis of a court decision, or
- this is supported by particularly significant circumstances, including those related to being subjected to domestic violence
- during the marriage, or
- as a former spouse of an EU citizen, has the right to visit a minor child, based on an agreement between the former spouses or on the basis of a court decision, when the agreement or decision states that the visit takes place on the territory of the Republic of Poland.
In the event of the death or departure of an EU citizen from the territory of the Republic of Poland, a child of an EU citizen residing and learning or studying in this territory, and the parent taking care of him, regardless of his citizenship, retain the right of residence until the child completes education or studies.
A spouse of an EU citizen, a child of an EU citizen or his/her spouse up to 21 years of age or dependent on an EU citizen or his/her spouse, a parent of an EU citizen or his/her spouse who is dependent on an EU citizen or his/her spouse. A family member is both an EU citizen and a foreigner without the citizenship of an EU country.
A family member of a UK citizen means the following persons, regardless of nationality:
- spouse
- the partner with whom the Union citizen has entered into a registered partnership, on the basis of the legislation of the Member State concerned, if the legislation of the host Member State recognizes the equivalence between registered partnership and marriage, and under the conditions laid down in the relevant legislation of the host Member State;
- direct descendants (children) who are under the age of twenty-one or are dependent, and those of the spouse or civil partner
- dependent direct ascendants (parents) and those of the spouse or civil partner
- persons other than those defined above, whose presence is necessary for UK citizens so that these UK citizens are not deprived of the right of residence granted to them under the Withdrawal Agreement (this category concerns the right of residence of the immediate ascendant minor of the EU citizen having actual custody of that minor EU citizen and on whom the minor EU citizen is dependent).
Family members of a UK citizen are beneficiaries of the Withdrawal Agreementif they meet one of the following conditions:
- they lived in Poland in accordance with EU law before the end of the transition period and still live here;
- were directly related to the above-mentioned UK citizens and resided outside Poland before the end of the transition period, if they meet the above conditions at the time of applying for a stay under the Withdrawal Agreement in order to join the abovementioned UK citizens;
The Withdrawal Agreement also provides for a category "Family members to come" - children of the above-mentioned citizens of the UK (does not include children of the spouse, unless also adopted by the above-mentioned citizen of the UK) or adopted by them, born or adopted after the end of the transition period, in the host country or outside its territory, up to the age of 21 and dependent on a UK citizen or his/her spouse/partner who meets one of the following conditions at the time of applying for residence in order to join the above-mentioned UK citizens:
- both parents are UK citizens;
- one of the parents is a citizen of the UK and the other is a citizen of the host country; or
- one of the parents is a citizen of the UK and has sole or joint custody of the child.
