Dictionary of concepts

 Citizen of the UK and/ or family member of a UK citizenwhich based on Withdrawal Agreements, after the end of the transition period, will have the right to stay in Poland, in principle, under the existing conditions, if:

– used the right of residence in Poland in accordance with EU law before the end of the transition period (this also applies to UK citizens who entered Poland after the Brexit date and before the end of the transition period);

– still lives in Poland.

For the acquisition and maintenance of the rights of the beneficiary of the Withdrawal Agreement, the continuity of stay immediately before and after the end of the transition period will be important.

Unconditional stays of up to 3 months (no conditions for stays exceeding 3 months) will also be considered. Citizens of the United Kingdom will not have to stay in Poland on 31.12.2020 to have residence rights under the Withdrawal Agreement. Absences (interruptions in residence) are allowed, which are applicable for the purposes of acquiring the right of permanent residence. This principle will also apply to the assessment of the continuity of stay in Poland after the end of the transition period.

In other words: an apatrid is a person who is not considered a citizen of any state within the scope of its law.

Shortcomings in the application, which make it impossible to proceed with the case, i.e. lack of the applicant's signature, lack of his address, unspecified content of the request, incorrectly completed application form, etc. In cases for granting Polish citizenship by the President of the Republic of Poland, formal defects are also missing in those documents that are important to determine the current situation of the applicant (e.g. marital status, number of minor children covered by the application, gainful activity, Polish origin, etc.). If the application contains formal deficiencies or not all documents are attached to it, the request is made to remove these deficiencies within 30 days from the date of receipt of the request. After the expiry of this period, the application is left unprocessed.

The formal assessment of the application is the initial stage of the entire procedure, then we check the documents you have submitted. If your application contains formal deficiencies, we will send you a letter to supplement them and set a deadline by which you will be able to complete them. If you do not complete the documents you will be asked for, your application will not be considered - it will stay left unrecognized. If your application does not contain any formal defects or you complete them, the documents you submit will be verified in terms of the possibility of granting a residence permit in Poland.

British frontier worker (frontier worker) - a citizen of the United Kingdom who, before December 31, 2020, performed work or conducted other gainful activity in his own name and on his own account in the territory of the Republic of Poland and was not subject to the obligation to register his stay (no residence in this territory) and after that date still performs work or carries out such activities in this territory and at the same time does not reside there.
